The Supreme Court gave a very important decision on Right to Privacy on Aadhar card on Thursday and declared privacy as a part of fundamental rights. Under the next step, the Bench will now decide whether the Aadhaar card should be linked to various schemes. In relation to Aadhaar card, the matter of 5 judges is sent to the bench.

The Constitution Bench of nine judges reversed the decisions made in 1954 and 1962, saying that Right to privacy is part of the right to life given under fundamental rights. Now the bench of 5 judges will take the hearing on the basis. Senior advocate KTS Tulsi said in this regard that the direction in which the country will go will now be decided by this verdict.

The petitioner and the famous lawyer Prashant Bhushan came out of the court and told that the court has recognized the right to privacy as a fundamental right and said that it comes under Article 21. The court has not taken any decision regarding the Aadhar card. In the case of Right to Privacy at the end of last month, the Constitution Bench of nine judges asked the Central Government whether there is any strong mechanism to protect the Aadhar’s data?

In fact, the bench of 8 judges in 1950 and the bench of 6 judges in 1962 had said that ‘Right to privacy’ is not a fundamental right. The bench of the Supreme Court includes CJI JS Khehar, Justice J. Chelameswar, Justice AR Bobde, Justice R.K. Agarwal, Justice Rohinton Nariman, Justice Abhay Honor Spray, Justice DV Chandrachud, Justice Sanjay Kishan Kaul, and Justice Abdul Nazir.
